Glo Dragged to Court in ₦20bn Suit Over Alleged Breach of 2.6GHz Spectrum Contract

Telecommunications operator Glo Mobile Limited, the Nigerian Communications Commission (NCC), and indigenous firm Megatech Engineering Limited have been sued at the Federal High Court in Abuja over an alleged breach of contract involving the sale of a 2.6GHz spectrum licence.

 

The suit was filed by Mosakab Nigeria Limited and its promoter, Mashood Mustapha, who are seeking over ₦20 billion in damages, alleging unlawful conduct, fraud, and contractual violations linked to the transaction.

 

In the case marked FHC/ABJ/CS/1534/2024, the plaintiffs are asking the court to nullify or set aside the sale of the 2.6GHz spectrum licence by Megatech to Glo Mobile, arguing that the transaction was tainted by fraud and illegality.

Megatech Engineering Limited, Glo Mobile Limited, and the NCC are listed as first, second, and third defendants respectively. The suit was filed by George Ibrahim, SAN, of Ogwu James Onoja, SAN & Co.

 

The plaintiffs also want the court to compel Megatech to pay $10 million allegedly owed to them under a consultancy agreement executed on June 29, 2017. According to the claim, Mosakab Nigeria was engaged as a consultant to facilitate the acquisition of the 2.5/2.6GHz spectrum band for national licence operations.

 

In addition, the plaintiffs are seeking an order directing the NCC to revoke the 2.6GHz spectrum licence issued to Megatech in March 2020, which they claim was obtained through their professional facilitation.

 

In their statement of claim, Mosakab and Mustapha maintained that they fully discharged their contractual obligations and are entitled to an outstanding balance of $9,578,947. They are also asking the court to award ₦50 million as the cost of litigation.

 

Justice Mohammed Garba Umar of the Federal High Court has fixed March 3, 2026, for the hearing of the case.
